        A motorcycle rider was fatally injured in a rolling argument with a cabdriver Thursday afternoon on the Eastside.

        Indianapolis police did not detain or cite the cabdriver. But, they said, the investigation is not complete.

        The incident started at 5:30 p.m. near 38th Street and Massachusetts Avenue, police said.

        The motorcycle rider, whose name was not immediately released, was in front of the Yellow Cab taxi at a red light as both were westbound on Massachusetts.

        Police identified the cabdriver as Richard Harvath, 43, 2000 block of Amerherst Drive. Sgt. Russell Burns, an Indianapolis Police Department spokesman, said investigators ended their questioning of Harvath at the scene when the cabdriver asked to speak to an attorney.

        According to police, when the light changed to green, the motorcycle did not immediately move, the cabdriver blew his horn, and the motorcycle rider made a "gesture" at the cab.

        The motorcycle headed west after the light changed, and the cab tailgated the bike, finally crossing over the double yellow line on two-lane Massachusetts Avenue to pass the motorcycle, police said.

        When the cab braked in front of the motorcycle, the rider hit his brakes and went out of control. He was thrown into oncoming traffic, where he was struck by an eastbound vehicle, according to police. He was not wearing a helmet, Burns said.

        The motorcycle rider died of severe head injuries at Methodist Hospital

          Man, that was some reckless-a$$ BS on the part of the cab-driver. The only reason they didn't take him in is because he requested to speak with his lawyer before continuing. There were loads of witnesses supporting the scenario as the paper recalled it , so I'm sure some seriously bad stuff's gonna happen to him. Whatever it is probably won't be bad enough. They didn't release the ID of the rider, but what if he has a family and/or kids? He might not have intended to, but he murdered that guy in my eyes...

            Manslaughter for sure! Not sure about the Cabs in Indy but here in Chicago, most of the drivers are foreign and do not even have a Green Card which means no real harsh legal action can take place other than Deportation and most return w/in 6 mos to a year - I got into a long discussion one night in a cab with a driver about this type of $hit! - It was just after 9/11 and all the cabbies were being VERY nice to their passengers.

            I pray for the riders family and may the cabbie get what is coming to him !

                That is shitty....

                You just never know when you go out on the road. There is something tyou don't want to be missing in this article. Cagers are real brave when confronting motorcycles so be careful what you do (gestures etc) or say, some of those fools make take that as an invitation to really "mess with your flow" out on the boulevards and all us 2-wheelers know how dangerous that can be.

                  That cab driver should be tied to the end of a bike and dragged on pavement for about 2 hours and see how he likes it!!!!!!!!

                      1) Tailgateing, crossing over a double yellow to pass... those two things are illigal in themselves, even when not leading to death.

                      2) Motorcyclist died of head injuries, as he was not wearing a helmet.

                      Sounds to me like the Motorcyclist could have lived through this had he worn a little protection. But it seems as if the case is pretty open and shut, it doesn't matter that the motorcyclist gestured or not, Killing someone, be it intentional or not is not legal

                              He only died because he wasn't wearing a helmet.. At least that's what the other cagers will say.

                              Has nothing to do with the fact that the cabbie was trying to hurt him.

                              They didn't take him in because he wanted to talk to his Lawyer? CALL HIM FROM JAIL... They had corroborating witnesses, and they STILL didn't take him in..

                              This is going to go nowhere fast. They'll blame the bike and screw the guy.. after all he was riding a motorcycle, he was asking for it...
